Employment Law Update:  Updated EEOC Posting Requirements

In response to the Pregnant Workers Fairness Act and the PUMP for Nursing Mothers Act, the Department of Labor and the EEOC are in the process of updating required Employment Law posters.  At the end of April, the Department of Labor issued a new FLSA poster and a new FMLA poster. More information can be found about these posters in our May Employment Law Update.

The Equal Employment Opportunity Commission has released an update to the “Know Your Rights: Workplace Discrimination is Illegal” poster that will be effective on June 27, 2023. This update reflects the changes under the Pregnant Workers Fairness Act, which will also become effective on June 27, 2023. Changes to the poster include additional categories of illegal discrimination such as:

  • Failure to provide a reasonable accommodation for pregnancy, childbirth, or a related medical condition;
  • Interference, coercion, or threats related to the exercise of rights related to disability discrimination or pregnancy accommodation; and
  • Conduct that coerces, intimidates, threatens, or interferes with someone exercising their rights, or someone assisting or encouraging someone else to exercise rights, regarding disability discrimination (including accommodation) or pregnancy accommodation.  

Employers should post the updated Know Your Rights poster starting on June 27, 2023 to remain in compliance with posting requirements.  The EEOC recommends waiting until that date to update the poster in order to avoid confusion.  A printable copy of the updated poster can be found on the EEOC website.
