David Jason Klein, a member of the Firm's Water and Districts Practice Groups since 2006, focuses on representing water utilities, municipalities, water districts, water authorities and landowners with their water supply, water quality, and water and sewer utility service interests.  Before joining the firm, David worked at the Texas Commission on Environmental Quality, specializing in water rights, water utility permitting, water utility rates, dam safety, and district matters.  David earned his doctor of jurisprudence from The John Marshall Law School in Chicago, Illinois, in 1997, where he was a published author in the John Marshall Journal of Computer and Information Law.  As a member of this law review, David also acted as the Solicitation Editor.  While attending law school, he also participated in the University of Chicago Graduate School of Business Graduate-Student-at-Large Program.  David is originally from Dallas, but for the last nine years has called Austin home.

Areas of Practice

Representative Experience

  • Represent clients in contested case hearings at the State Office of Administrative Hearings
  • Prepare and prosecute applications at  the Texas Commission on Environmental Quality for water rights, water quality permits (TPDES, TLAP), and water district matters
  • Assist clients with drafting development agreements and water supply contracts
  • Represent municipalities, districts, investor owned utilities, and developers in obtaining, amending, and decertifying water and sewer certificates of convenience and necessity (CCN), and dealing with 7 U.S.C.A. § 1926(b) related issues 
  • Assist clients in wholesale and retail water and sewer rate change applications
  • Serve as general counsel for water districts and water supply corporations
  • Experienced in TCEQ rulemaking initiatives
  • Assist clients with applications at Texas Water Development Board for funding under the State Revolving Fund (SRF) / American Recovery & Reinvestment Act (ARRA)
